The Warren Firm, PLLC Secures Successful Case Result for Injured Motorcycle Rider

The Warren Firm, PLLC is pleased to announce that Charlottesville Personal Injury Attorney Vaden Warren and our legal team were recently successful in securing a positive recovery on behalf of a motorcycle accident victim who faced challenges with not having enough insurance. Although the case presented a number of difficulties when it came to coverage, our experience, insight, and commitment proved fruitful in ensuring that our client recovered the compensation they need.

Our client was a passenger on a motorcycle who suffered serious injuries when the driver of a motor vehicle failed to yield the right-of-way and caused a collision. The at-fault driver was charged and found guilty for her neglect to yield. Out client suffered a comminuted femoral neck fracture and left tibia shaft fracture and hypotension.

Due to the severity of her injuries, our client was required to stay in the hospital for several days, and required an open reduction and internal fixation using medical hardware to repair her femur fracture. She continues to experience pain in her leg and, in addition to regular physical therapy, has been seeing a counselor to deal with her stressful and traumatizing experience.

In total, our client incurred nearly $200,000 in medical expenses, as well as roughly $12,000 in lost wages. Unfortunately, there was only $100,000 in available insurance coverage, and the health insurance claimed a lien for more than $80,000. Through diligent efforts, our legal team was able to get a substantial reduction to the lien so our client could make a financial recovery.

Our Virginia personal injury law firm represents many victims of auto accidents and other preventable incidents who face similar issues involving insufficient insurance. At times, a lack of coverage can make it exceedingly difficult for injured victims who have suffered damages to obtain the financial compensation they need to cover all of their losses, including their pain and suffering, emotional injuries, lost wages, and medical bills. If you don’t understand your policy or don’t know if you have enough coverage, we will gladly review your policy with you free of charge.

Often, it is a wise decision to purchase uninsured or underinsured motorist coverage (UM / UIM) as part of your insurance policy. Doing so can protect you in the event that you are harmed by a motorist who has limited insurance coverage. When you are injured in a wreck and the at-fault driver does not have enough or any insurance to cover your damages, for example, you would be able to file a claim with your own insurance provider to recover the difference – provided that you have UM / UIM coverage. Being prepared for the unexpected can make the difference when it matters most.
